Mbowe ashinda Rufaa dhidi ya Hukumu kesi ya Shambulio....Mahakama Yaamuru arejeshewe Milioni 1 aliyolipa kama faini.

Mahakama Kuu ya Tanzania Kanda ya Moshi leo imeifuta hukumu iliyomtia hatiani Mwenyekiti wa Taifa wa Chadema, Freeman Mbowe na kuamuru arejeshewe Sh1 milioni alizolipa kama faini.

Hukumu hiyo ilitolewa leo na Jaji Mfawidhi wa Mahakama hiyo, Aishiel Sumari baada ya upande wa Jamhuri ukiongozwa na wakili mwandamizi wa Serikali, Tamari Mndeme kukubali rufaa hiyo.

Mbali na sababu za rufaa zilizowasilishwa mahakamani na wakili wa Mbowe, Peter Kibatala, wakili Mndeme aliiongeza sababu zingine mbili zinaonyesha mapungufu ya hukumu hiyo.

Wakili Mndeme alimweleza Jaji kuwa shitaka lenyewe na maelezo ya shitaka vilikuwa vinatofautiana hivyo kuathiri uhalali wa shitaka na uhalali wa hukumu iliyomtia hatiani Mbowe.

Mbowe alitozwa faini ya Sh1 milioni au kutumikia kifungo cha mwaka mmoja jela kwa kosa la kumshambulia mwangalizi wa ndani wa uchaguzi mkuu wa 2010 katika wilaya ya Hai, Nassir Yamin.

Hukumu hiyo iliyolalamikiwa na Mbowe kuwa haikumtendea haki kwani kesi hiyo ilifunguliwa kisiasa, ilitolewa Juni 17 mwaka huu na Hakimu Mkazi wa wilaya ya Hai wakati huo, Denis Mpelembwa.

Hata hivyo, Mbowe ambaye pia ni mwenyekiti mwenza wa Umoja wa Katiba ya Wananchi (Ukawa), na mgombea ubunge wa Jimbo la Hai alilipa faini hiyo na kuachiwa huru na Mahakama ya wilaya ya Hai.
